Terms of Service
The agreement between you and Aviary Technologies Ltd when you use Aviary Hosting.
These terms cover Minecraft server hosting supplied by AVIARY TECHNOLOGIES LTD. Your order describes the plan you buy. Our Refund and Cancellation Policy forms part of your contract; our Privacy Policy explains how we handle personal information. Bracketed completion notes must be resolved before this draft is brought into force.
1. Who we are and how to contact us
We are AVIARY TECHNOLOGIES LTD, company number 17277024, registered in England. Our registered office is 124 City Road, London, EC1V 2NX, United Kingdom. In these terms, “Aviary”, “we”, “us” and “our” mean that company.
For support, open a ticket through Billing. For privacy matters, cancellation notices or other formal notices, email privacy@aviarytechnologies.co.uk or write to our registered office. Include enough information to identify the relevant account or service, but never send your password or full card details.
2. Your account and your order
The account holder must be at least 18. A parent or guardian may open and manage an account for a child, but the adult is the contracting party. If you order for a business, school or other organisation, you must have authority to bind it. Paying with a card does not establish your age or authority.
Keep your account details accurate and your credentials secure. Use separate authorised-user access where available, and tell us promptly if you suspect misuse. You are responsible for the instructions and use of people you authorise to operate your account, to the extent permitted by law. This does not make you responsible for a security failure caused by us.
Before ordering, you must be able to review the service, resources, total price, billing dates and cancellation arrangements. We accept an order when we confirm acceptance or activate the ordered service, whichever happens first. A payment acknowledgement alone is not acceptance. We will supply a confirmation that you can save, containing the applicable terms and cancellation information.
3. What we supply
We provide the server resources and features described in your accepted order, using reasonable care and skill. Only services actually offered and ordered are included. Other games, website hosting and the application builder are future products and are not supplied under this version merely because we have discussed or announced them.
Minecraft hosting currently runs on infrastructure in Germany and Finland. We primarily serve UK and EU customers. Customers elsewhere may order where lawful and available, subject to the location and latency information shown before purchase. Any quoted latency estimate must come from a measurement relevant to the intended connection; an estimate is not a guarantee of constant network performance.
We do not promise uninterrupted availability, a particular uptime percentage, a fixed player count or lag-free play. Performance can be affected by your connection, game version, configuration, world size, plugins and other factors. This does not reduce our obligation to supply the resources and service described or your remedies when we fail to do so.
You may configure your server, upload lawful plugins and download your world files using the available facilities. You must hold the required licences and choose software compatible with your plan. We may ask you to remove or change a plugin that breaches these terms, presents a substantiated security risk or interferes with other customers. We will explain the reason where we lawfully can.
Support is available through Billing tickets. We will provide an initial response within three working days; this is not a promise to resolve every issue within that period. Working days are Monday to Friday, excluding public holidays in England and Wales. Support includes issues with our hosting; custom plugin development is included only if separately agreed.
4. Free beta month and monthly payments
Where your order includes the beta offer, the first month is free. A payment card is still required. If the service continues after that month, we charge the monthly price shown and agreed at checkout, starting on the first payment date shown there. The order must show the free period’s end, the first charge date and the amount and frequency of later payments.
We will notify you before the first paid renewal. You may cancel before that charge without paying for the next month. Saving a card alone is not permission to charge it: recurring charges must be authorised through the checkout arrangements disclosed to you.
Paid plans renew monthly until cancelled. Stripe processes card payments. Charges are due on the renewal date shown for your service, subject to the disclosed billing arrangements. We do not promise a particular time of day. Keep your payment method and contact email up to date.
Prices shown include any VAT that applies. The total payable is shown before you commit. Your invoice identifies applicable VAT. We do not add an undisclosed compulsory fee after you order. Changes to your regular price are governed by section 12.
If you ask for a plan change, we will disclose its price and effective date before you agree. Downgrade refunds are explained in the Refund and Cancellation Policy. This draft does not establish an automatic charge formula for a mid-cycle upgrade.
5. Cancellation and unpaid accounts
You may cancel through a Billing ticket or by a clear notice using the contact details in section 1. Tell us whether you want the service to end now or at the end of the paid period. We will confirm the end date and any refund. Merely stopping a server does not cancel its subscription or release the resources reserved for it.
Our Refund and Cancellation Policy explains statutory withdrawal rights, the first-payment guarantee, unused-time refunds and refunds for a qualifying latency problem. Export files you want to keep before your service ends. If you need help obtaining them, contact us promptly; do not assume a cancelled server remains available indefinitely.
If payment remains overdue, we may suspend the service after it has been overdue for at least two days. Suspension stops the server; it does not itself delete the server files. If payment is still overdue after at least fourteen days, we may terminate the service and permanently delete the live server. A daily scheduled process applies these thresholds, so action may happen later. These are minimum grace periods, not exact action dates or maximum data-retention periods.
We will notify you of an unpaid balance and warn you before deletion, identifying what you must do to avoid it. Contact us promptly about a disputed invoice. We will consider a genuine dispute fairly before taking avoidable destructive action. Deleted live servers may not be recoverable; backups and other records follow the separate retention arrangements in the Privacy Policy.
6. Acceptable use and commercial activity
Use the service lawfully and respect other people’s rights. You must not use it for malware, phishing, spam, unauthorised access, attacks, unlawful surveillance, infringement, or pornography or other sexually explicit adult content. You must not attempt to bypass resource limits, isolation or security controls, or deliberately disrupt other users or our infrastructure.
Cryptocurrency mining and unrelated resource-intensive workloads are prohibited, including distributed computing, AI model training and video transcoding. This restriction concerns what runs on the hosting. It does not itself prohibit accepting cryptocurrency from your own players, where that payment and its purpose comply with law and the game publisher’s rules.
You may operate a lawful public server and earn money from permitted player access, donations, cosmetic ranks, videos or streaming, subject to the relevant publisher’s rules. You may build your own business using the service. You may not resell or sublet the hosting itself, allocate hosted server capacity to third-party customers, or sell hosting-panel accounts or administrative access as a hosting service. Ordinary player admission to your own game server and authorised co-administration are not, by themselves, resale of hosting.
For Minecraft, comply with the applicable game licence and Minecraft Usage Guidelines, including their server and commercial-use requirements. Reference checked on 21 September 2026. Publisher rules operate separately from these terms; our permission does not override them. If a publisher change requires a material change to our service, section 12 applies, subject to any immediate legal requirement.
NOT AN OFFICIAL MINECRAFT SERVICE. NOT APPROVED BY OR ASSOCIATED WITH MOJANG OR MICROSOFT.
7. Staff access and operational AI
Staff access to customer files must have a specific support, maintenance, security or legal purpose. We limit it to what is reasonably necessary. We may inspect files when you ask us to help, or where inspection is necessary to investigate a substantiated service or security issue. Unusual traffic alone does not authorise unrestricted browsing of customer content.
Before an intended world-file inspection, we will email you explaining what we propose to inspect and why, and give you an opportunity to raise a concern. A human at Aviary will consider that concern and decide whether a lawful, necessary and proportionate inspection should proceed. Your silence is not consent. Where urgent action is necessary to protect people or systems, or advance notice is legally prohibited, we may act first and explain as soon as we lawfully can. We will tell you what was accessed and why.
Staff must not join your game server without permission. Our operating rules prohibit querying console or chat logs for routine support or monitoring. Access to chat records under an external request requires verification of the requester’s identity and legal authority, a valid legal basis, and a decision by an authorised human. We limit any disclosure to what is necessary and tell you unless the law prohibits it.
We use Anthropic’s Claude to help operate and support the service. Our working practice requires an AI agent to obtain staff approval before accessing customer files. This is a staff-supervised rule, not a technical control that guarantees prevention or detection of every unauthorised access. Information read in an operational session may be processed by Anthropic; model training is disabled for our operational use. The Privacy Policy explains this processing.
File-access auditing and alerts operate on the game nodes, but they do not provide a complete record of every way content can be viewed. In particular, opening a live console is not currently logged. If we become aware of unauthorised console, chat or other customer-content access, we will notify the affected customer promptly, explain what we know and take appropriate action, unless notification is legally restricted. We cannot promise to detect every console view.
These terms do not authorise routine reading of player chats or use of customer content to train external AI models. They also do not claim that future customer-facing AI support, proactive intervention or an AI opt-out control is already available.
8. Your content and intellectual property
You retain the rights you hold in your worlds, uploads and other content. You give us the limited permission needed to host, copy for backups, transmit and otherwise handle that content to provide the service, follow your lawful instructions and meet legal obligations. This is not a transfer of ownership to Aviary or permission to exploit your content for advertising or AI training.
You are responsible for having the rights needed to upload and use third-party material. Aviary and its licensors retain their rights in the hosting platform and software. Purchasing hosting does not transfer those rights. Any future application-builder code licence requires separate terms and is not created by this hosting contract.
9. Your players and personal information
When you run a server, you decide who may join, how it operates and what it records. Where data protection law applies to that activity, you are responsible as controller for your players’ information and we process hosted information on your instructions. Tell your players what you collect and why, and that AVIARY TECHNOLOGIES LTD hosts it for you. Have a lawful basis for the processing and provide any notices or safeguards needed for children.
We will provide reasonable assistance with requests concerning information we host for you. Our own account administration, billing and security processing is explained in our Privacy Policy. Players do not become parties to this contract merely by joining your server, and this contract does not make them “accept” our Privacy Policy.
10. Backups and service interruptions
We use backups to support recovery. Game-node backups currently cover approximately 30 days. This is not a guarantee that every change is backed up or that any file can always be restored. Keep your own downloads of important worlds and files. We will still exercise reasonable care and remain responsible for failures for which the law makes us responsible.
We may carry out maintenance or take necessary action to protect the service. We will give reasonable advance notice of planned work where practicable and minimise avoidable disruption. If a problem substantially prevents us from supplying the service, contact us for the remedies described in the Refund and Cancellation Policy and available under law.
11. Suspension and termination for other reasons
We may restrict or suspend the affected service when reasonably necessary to address a material breach, a substantiated security threat or a legal requirement. Where safe and lawful, we will explain the issue and allow a reasonable opportunity to put it right. Immediate action may be necessary for serious abuse or an urgent threat. We will use a proportionate response and review it when you provide relevant information.
We may end the contract for a serious breach or an unresolved material breach after a reasonable warning. We may also withdraw a service with at least 30 days’ notice, unless a shorter period is necessary for a legal or urgent security reason. We will refund unused prepaid hosting under the Refund and Cancellation Policy. There is no automatic forfeiture of all payments merely because we suspend or terminate a service.
You may ask for a human review through Billing or the formal contact route. Any separate claim for loss must have a lawful basis; it does not remove your statutory rights.
12. Changes to prices or terms
We will give at least 30 days’ notice before an increase to your recurring price or another material adverse change takes effect. A material adverse change includes reducing included resources, removing a substantial feature, or changing service locations or supported territories in a way that materially reduces what you receive.
You may cancel before that change takes effect and receive any applicable unused-time refund. A price increase applies no earlier than the next renewal after the notice period; it does not rewrite an already-paid period. A required urgent legal or security change may need shorter notice. We will explain the reason and preserve your applicable cancellation and refund rights.
We may correct errors or make clarifications that do not reduce your rights without treating them as material adverse changes. We will date revised terms. Changes do not retrospectively remove rights that have already arisen.
13. Responsibility and liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything that cannot lawfully be limited. Nothing removes a consumer’s statutory rights or reduces a refund we owe under the Refund and Cancellation Policy.
For consumers, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill, subject to applicable law. Loss is foreseeable if it was an obvious consequence or both parties knew it could happen when the contract was made. You must take reasonable steps to avoid unnecessary loss, but keeping your own backups does not excuse a breach by us.
For business customers only, and subject to the exclusions from limitation above, our total aggregate liability arising in any twelve-month period is limited to the greater of £100 or the hosting fees you paid us in the twelve months immediately preceding the first event giving rise to the relevant claim. Related claims are treated as arising from the same event. For business customers only, we exclude indirect and consequential losses to the extent the law permits. These limits do not cap an express refund entitlement.
14. Complaints and governing law
Raise a complaint through Billing or the contact details in section 1. Explain the problem and the outcome you seek. You can ask for a human review of an automated billing action or access decision. Using our complaints process does not prevent you from exercising legal rights or contacting a regulator.
These terms are governed by the law of England and Wales. For business customers, the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rule. For consumers, this choice does not remove mandatory protections of the country where you normally live or your right to bring proceedings in any court available to you under applicable consumer law. EU consumers retain the mandatory protections of their own country where applicable.
If part of these terms cannot lawfully be enforced, the remaining provisions continue to apply so far as the law permits. We may not use that provision to substitute a less favourable bargain for a consumer. Neither party loses a right merely by delaying its enforcement.
